Terms of service
The agreement for using Egameno
Draft — not yet legally reviewed
This document describes how the system works today and has been checked against the code. It has not been reviewed by a lawyer, and it must be before Egameno is offered commercially. What is still outstanding is listed at the end.
Who you are contracting with
Egameno is provided by Egameno (Pty) Ltd. Its registration number and registered address are not published here yet; they are being confirmed and will be added rather than approximated, because a company number that turns out to be wrong is worse than one that is openly still coming.
What Egameno is
Egameno is subscription software for managing health, safety, security and environmental operations — recording incidents, permits to work, risk assessments and the actions that follow them. It is provided as a service over the internet; there is nothing to install and nothing to run yourself.
Egameno is a tool, not a safety authority
This is the most important clause on the page. Egameno records what your organisation tells it and makes that record easier to keep, find and audit. It does not decide whether work is safe, does not discharge any duty you hold under health and safety law, and does not replace a competent person's judgement.
Responsibility for safe operation, for regulatory compliance, and for acting on what the system records remains entirely with your organisation.
Subscriptions and payment
Access is sold as a package, priced per operational site with a number of user logins included. What each package includes is shown at the point of purchase and recorded against your subscription, so changing what a package includes for new customers does not change what you already bought.
Payments are processed by Paddle, who act as the merchant of record. Paddle is the seller for the transaction, issues your invoice, and handles sales tax. Paddle's own terms apply to the payment itself.
Renewal, cancellation and what happens to your data
Subscriptions renew automatically until cancelled. You can cancel at any time and keep access until the end of the period you have paid for; we do not refund part of a period that has already started.
If a payment fails, we will not lock you out immediately. A safety team losing access to their incident records because a card expired is a worse outcome than a late payment, so access continues while the failure is resolved.
When a subscription ends, you can export your records. We keep them for a limited period afterwards so an accidental cancellation is recoverable, then delete them.
Your account
You are responsible for keeping your password to yourself and for what happens under your login. Tell us promptly if you think someone else has access to it. Accounts are for one person — sharing a login makes the audit trail meaningless, which defeats much of the point of the product.
Availability
We aim to keep Egameno available continuously, and we do not currently offer a contractual uptime commitment. Where you need one, it belongs in a written agreement rather than on this page.
Your data stays yours
Everything your organisation records in Egameno remains your organisation's. We process it to provide the service and for no other purpose. We do not sell it, do not use it for advertising, and do not train anything on it. How it is handled is described in the privacy notice.
Changes to these terms
If we change anything of substance we will tell account holders before it takes effect, and the version at the top of this page will change.
Outstanding before launch
- The registration number and registered address of Egameno (Pty) Ltd, and the governing law and jurisdiction. The entity itself is settled as of 2026-08-23; these are not.
- Limitation of liability. This is the clause that most needs a lawyer, and it is deliberately absent rather than guessed at: an unenforceable limitation is worse than none, and for safety software the exposure is real.
- Concrete figures for the export window and the deletion period after cancellation.
- Whether an uptime commitment is offered, and what remedy attaches if it is missed.
- Acceptable use, suspension and termination for cause.
- A data processing agreement to sit alongside these terms for customers who require one.
